Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the OpticPOS platform at opticpos.com and related services (collectively, the “Service”). By creating an account, you agree to these Terms. If you don’t agree, don’t use the Service.
1. Who provides the Service
The Service is operated by Moneti Consulting Services Pvt. Ltd.(“OpticPOS”, “we”, “us”), incorporated in India with its registered office in Jangaon, Telangana. Questions about these Terms: [email protected].
2. Your account
- You must be at least 18 years old and legally able to enter into a contract.
- You’re responsible for everything that happens under your credentials. Keep them secret. Enable 2FA.
- Tell us immediately if you suspect unauthorised access to your account.
- We may reject or revoke any account that violates these Terms or applicable law.
3. Free trial and subscriptions
- Free trial — 14 days, no credit card required.
- Subscriptions begin on the first successful payment and auto-renew on the same cadence (monthly or annual) until cancelled.
- Cancel anytime from Settings. Your access continues through the end of the billing period you’ve already paid for.
- Price changes give you at least 30 days’ notice before your next renewal.
- Taxes (GST) are added where applicable.
4. Acceptable use
You agree not to:
- Use the Service to violate any law or third-party right.
- Upload malware, scrape at abusive rates, or interfere with the Service.
- Resell, white-label, or sub-license the Service without written permission.
- Attempt to bypass tenant boundaries, RBAC, rate limits, or access another tenant’s data.
- Use the Service for activity we reasonably consider fraudulent, deceptive, or harmful to customers.
5. Your data
You retain ownership of every piece of data you put into OpticPOS — your customer records, invoices, Rx history, product catalog. We only use it to provide the Service and in the aggregated, anonymised ways described in ourPrivacy Policy.
You’re responsible for obtaining lawful consent from your customers before entering their personal data into OpticPOS, and for handling Data Principal requests from them under the DPDP Act.
6. Our IP
The software, design, and brand of OpticPOS belong to us. We grant you a limited, non-exclusive, non-transferable right to use the Service for your own retail operations for as long as your subscription is active. No other rights are granted by implication.
7. Uptime and support
- We target 99.9% monthly uptime across Starter and Professional plans.
- Enterprise plans can include contractual SLAs with service credits.

8. Suspension and termination
We may suspend or terminate your access if you materially breach these Terms, fail to pay, or put the Service or other customers at risk. We’ll usually give you notice and a chance to fix the issue first, unless the situation is urgent.
On termination, we keep your data for 90 days (to allow restoration) and then permanently delete it, except where law requires us to retain it longer.
9. Disclaimers
The Service is provided on an “as is” and “as available” basis. We don’t warrant that it will be uninterrupted or error-free, or that any output (AI suggestions, analytics, inventory forecasts) will be fit for any particular purpose. Clinical decisions must always remain with the qualified optometrist.
10. Limitation of liability
To the maximum extent allowed by law, neither party is liable to the other for indirect, incidental, special, consequential or punitive damages. Our total liability to you for any claim arising out of or relating to the Service is limited to the greater of (a) the fees you paid us in the 12 months preceding the claim, or (b) ₹10,000.
11. Indemnity
You agree to defend and hold us harmless against any third-party claim arising out of (i) your misuse of the Service, (ii) your violation of any law or third-party right, or (iii) personal data you entered into OpticPOS in breach of the Privacy Policy or the DPDP Act.
12. Changes to these Terms
We may update these Terms occasionally. If a change materially affects your rights, we’ll email you at least 14 days before it takes effect. Continued use of the Service after a change means you accept the new Terms.
13. Governing law
These Terms are governed by the laws of India. Any dispute falls under the exclusive jurisdiction of the courts of Jangaon, Telangana.
